If you are suspected of committing a crime, or have been read your rights, do not speak to anyone without an attorney present. You have the right to have an attorney present when questioned by police and/or other military authorities - including your supervisor, first sergeant or commander. You are entitled to retain a civilian attorney or to be assisted by a military defense counsel.
If you are read your rights or questioned, inform your questioner you do not wish to talk to anyone without an attorney present. At that point, all questioning must stop. If you continue to be questioned, continue to be silent! Remember, the investigator’s goal is to get you to talk, which usually is to your disadvantage.
Once you ask for an attorney, most police and military officials will immediately stop questioning you. However, some may still encourage you to talk. Police may even lie to get you to talk. Don’t believe them. Remember - the person questioning you most likely believes you are guilty. Remain firm . . . continue to ask for an attorney and do not talk.
